Annulments

Are you trapped in a marriage that you believe should have never happened in the first place? you may be eligible for marriage annulment. Unlike a divorce, which requires you to be married for at least 3 years before you can file, you may be able to annul your marriage before this period if you can meet the required criteria. One of the parties must start the process with a writ on the grounds the marriage is either voidable or void.

We help with navigating the complex terrain of annulments, offering our expertise on both void and voidable marriages:

Void Marriages:

  • One party is already married.
  • Someone under 18 ties the knot without proper authorisation.
  • Marriages between Muslims registered under civil law.
  • Improper solemnisation of the marriage.
  • Blood relations between the parties.

Voidable Marriages:

  • The wife was already pregnant by another man at the time of marriage.
  • Incapacity leading to unconsummated marriage.
  • Wilful refusal to consummate the marriage.
  • Marriage without valid consent due to mental disorder, mistake, or duress.

If the annulment of marriage is uncontested [i.e., both parties agree to it] you could be free from the bonds of the marriage in 4-6 months. It is recommended to discuss your situation with an experience annulment lawyer who can deem whether your case is likely to be successful based on the required criteria. Contact us today to make an appointment for a consultation – the first one is usually free of charge.

Situations where separation may make sense

Choosing the right path for your separation is crucial, and we are here to guide you. Situations where separation may be preferred over divorce include shorter marriages, a desire to take time to decide the best course of action, strong religious beliefs, or the need to fulfil the Minimum Occupancy Period (MOP) for HDB flat sales.

Why a Deed of Separation?

A deed of separation agreement is a legally binding document that allows both parties to define the terms of their separation, addressing critical aspects such as:

  • Housing arrangements for couples no longer living together.
  • Equitable division of marital assets.
  • Custody, care, and control of your children.
  • Access arrangements for your children.
  • Maintenance obligations for both spouses and their children.

The Deed of Separation is a private document, not submitted to Court. It is essential to seek guidance from legal experts who have legal expertise in this area. We are here to provide you with the support and advice you need during this challenging time, ensuring you make informed decisions for your future.

Contact us today for a confidential consultation, and let us assist you in finding the best way forward for your separation.

Personal Protection Order

Seek help against family violence in Singapore

If you are in immediate danger, your first step should be to call the police without hesitation. Your safety is paramount. For victims of family violence or those who fear they may be at risk, there is a legal avenue to seek protection in Singapore—a Personal Protection Order (PPO). This order acts as an effective restraining measure against the person causing harm.

According to Section 64 of the Women’s Charter (Cap 353), “family violence” encompasses the following:

  1. Instilling Fear: Wilfully or knowingly instigating fear of harm in a family member.
  2. Inflicting Harm: Causing harm to a family member through actions that were known or should have been known to result in harm.
  3. Unlawful Confinement: Wrongfully confining or restraining a family member against their will.
  4. Continuous Harassment: Persistently harassing a family member with the intention of causing anguish or knowing that such actions are likely to inflict distress.

Your Safety Matters

Whether you are a victim of family violence or live in fear of potential harm, we urge you to reach out to us. We are here to discuss your situation, offer guidance, and explore the available options to ensure your safety.

Personal Protection Orders can be sought to protect against the following individuals:

  • Spouse or former spouse
  • Children, including stepchildren and adopted children
  • Father, mother, in-laws, or siblings of the offender
  • Any other relative or person who is unable to care for themselves, as determined by the Court, and should be considered a member of the family
