What is an Uncontested Divorce?

In an uncontested divorce, you and your spouse have reached an agreement on all the following matters:

  1. The fact to prove the irretrievable breakdown of the marriage ­
    • 3 years separation with consent
      • 4 years separation
      • Adultery
      • Desertion
      • Unreasonable behaviour
  1. Maintenance for the wife
    • Lump sum maintenance
    • Specific sum per month
    • No maintenance
  1. Children issues
    • Custody – joint or sole
    • Care and control – sole, shared, or split
    • Access
    • Maintenance
  1. The division of the matrimonial property / other matrimonial assets
    • Sold in the open market, with sale proceeds to be divided in specific proportions
    • Transferred or sold to one party

If you opt for an uncontested divorce, you and your spouse would decide on all the above matters. In a contested divorce, the final decision lies with the judge.

An uncontested divorce is also far quicker and cheaper than a contested divorce.
