An uncontested divorce is one where both the husband and wife can agree on every aspect of the divorce. Specifically, parties have to agree on the following before divorce papers are filed:

  1. The basis of the divorce: adultery, one party’s unreasonable behaviour, desertion for 2 years, parties’ agreement that they have been separated for 3 years and parties living apart for 4 years, without the need for both parties’ consent;
  2. The division of matrimonial assets;
  3. Custody, care and control, and access of the child(ren); and
  4. Maintenance for the wife and child(ren).

An uncontested divorce will be a lot more affordable and less time-consuming as opposed to a contested divorce where any of the issues, be it the basis for divorce or care and control of the child(ren), are not agreed upon. Therefore, it would be advisable for parties to come to an agreement before finding a lawyer.
