    3. FIXED DIVORCE FEES

    We offer low cost solutions if your divorce is friendly and uncontested. Our fixed fees for uncontested divorces are from $1,500 to $2,900 (inclusive of all disbursements and meetings with our lawyer). Read more about our fixed divorce fees here.

     

    If your divorce is contested, we offer fixed fees so that you know up front exactly what your fees will be. We do not charge you beyond your fixed fees.

    Commercial & Civil Cases

    • acting in a protracted and highly complex litigation in the Singapore High Court of one of the largest corporate bond defaults in emerging markets history. The claim was worth US$300 million and involved legal experts from the US and Indonesia.  The case was heard in 3 different countries and the parties litigated all the way up to the Supreme Court of  New York, the Supreme Court of Indonesia (the highest court in Indonesia) and the Singapore High Court.

     

    • advising the leading global operator of water services in employment matters and general corporate advice for its Asia Pacific office.
       

    • acting for Jurong Town Corporation to obtain urgent interlocutory injunctions against occupiers for causing nuisance and breach of contract.
       

    • acting for a government statutory board in property disputes and to obtain possession of property from errant tenants.

     

    • acting for all 8 defendants to successfully defend a US$27 million multi cause of action claim for breach of contract, breach of agency and conspiracy to defraud. The matter reached the Court of Appeal which upheld Chong Boon's arguments.
       

    • acting for one of the largest property agency companies in Singapore in an action against some of its former employees and agents for poaching its staff and for breach of contract.
       

    • defending former students in a defamation suit brought by a well- known options trading trainer.
       

    • acting for a US listed MNC in litigation over the construction of a wafer fab plant in Singapore.
       

    • acting for DBS Bank in the recovery of credit card and housing loans.
       

    • acting for the Nominee in the successful seeking of bankruptcy protection under the Bankruptcy Act for two directors of a Singapore listed company. This allowed the directors to resolve and restructure their personal liabilities of about $51 million arising out of corporate guarantees they had executed in connection with the debts of the company.
       

    • advising a major international hotel hotel chain in their dispute against their Singapore landlord.

     

    • acting in the Singapore High Court in litigation with an international construction and engineering company over the construction of a plant. The case was one of the first in Singapore to involve electronic discovery of documents stored in servers.

     

     

     

    Divorces

    • Successfully represented the mother in a bitterly fought custody battle over her two children.  The High Court accepted our arguments that the mother is a good and nurturing mother, despite the father's efforts to paint her as an unfit mother.  The Learned Judge awarded care and control of the children to Chong Boon's client and ordered the father to hand over the children to our client within 7 days, or face contempt proceedings.  The case was bitterly fought over 3 years and involved 2,000 pages of court documents.
    • represented a prominent and wealthy Singapore businessman in his divorce proceedings and ancillary issues.
    • acted for a prominent senior Singapore lawyer in a highly contentious divorce matter, division of assets and custody of the children.
    • represented the CEO of a listed company in his divorce proceedings and ancillaries.
    • acted for a wife to recover half of the ex-husband's lottery win.

    1. Dorothy was engaged by a client (the husband) to be the lead counsel in a complex and difficult case involving the division of multi-million dollar assets. The case was heard before a court of 3 Appellate Judges at Singapore's highest court, the Court of Appeal. Dorothy won the appeal and that decision has become one of the most important cases in Singapore divorce law because the Court of Appeal reaffirmed and summarized the new Singapore law on division of matrimonial assets [2015] SGCA 52].
     
    2. Dorothy's Court of Appeal case is now a landmark case in Singapore on division of matrimonial assets and has been subsequently cited and followed by the courts in such cases as Zhou Lijie v Wang Chengxiang [2015] SGHC 316; TIG v TIH [2015] SGHCF 12; TME v TMF [2016] SGHCF 6 and THL v THM [2015] SGHCF 11.

     
    3. Dorothy successfully represented the mother in a bitter custody battle over her 2 children. The High Court awarded our client care and control and ordered the father to hand over the children within 7 days or face contempt action. The case took 3 years and involved over 2,000 pages of court documents.
     
    4. Dorothy successfully represented the father and won for him care and control of the children. She also got for him a greater share of the matrimonial assets.
     
    5. Dorothy recently won a maintenance variation on behalf of the husband after she discovered that the former wife had a bank account which was not disclosed to the court.

This is an extremely important decision because in this case, the Court of Appeal affirmed and explained its earlier revolutionary decision in ANJ v ANK on the approach the Singapore courts must take in deciding the division of matrimonial assets. All divorce cases in Singapore involving division of assets must now follow this case and ANJ vs ANK.


    This is a case in which our client (the husband) had instructed us to act for him after he had lost at the lower court.

    After hearing arguments, the Court of Appeal allowed our client’s appeal and agreed with Dorothy that the High Court decision was wrong and awarded our client a sum of $800,000 for division of assets. Our client’s share was increased from 0% to 25%.

     

    The Court of Appeal said: “ In advancing her arguments, Miss (Dorothy) Tan highlighted the fact that the Judge had erred in law by applying what was generally known as the “uplift” methodology. This error consisted of taking the view that the wife’s indirect contributions should be reflected by applying an “uplift” to the share she would have been entitled to on the basis of her indirect financial contributions only. We accepted Miss Tan’s contentions on this score and we considered that the Judge had erred in that regard.”

    This case is extremely important and significant because the Court of Appeal reaffirmed and clarified its recent decision in ANJ vs ANK that in determining what is a fair and equitable division of matrimonial assets, the court will follow a structured approach consisting of 3 broad steps. These 3 broad steps are:

     

    (a) Express as a ratio the parties’ direct contributions relative to each other, having regard to the amount of financial contribution each party made towards the acquisition or improvement of the matrimonial assets;

     

    (b) Express as a second ratio the parties’ indirect contributions relative to each other, having regard to both financial and non-financial contributions; and

     

    (c) Derive the parties’ overall contributions relative to each other by taking an average of the two ratios above, keeping in mind that, depending on the circumstances of each case, the direct and indirect contributions may not be accorded equal weight and one of the two ratios may be accorded more significance than the other.

     

     

    Family Law Head Mr Lim Chong Boon said, “ This case together with ANJ is now taken as the new law in Singapore on division of assets. After the decision in ANJ, family law practioners were trying to understand the change in law. The Court of Appeal took the opportunity in this case to explain the new law and to reaffirm it. At a recent family law seminar, this case and ANJ were cited as the new law governing the division of assets in Singapore. Deputy Head Dorothy Tan has done us all proud. Our client is also extremely happy with the outcome.”

    It is axiomatic that when a former wife remarries, she is no longer entitled to maintenance payments from her former husband.

     

    Our team of lawyers, led by Low Jin Liang, represented the former husband. Our client had engaged us to stop the maintenance payments due to a change in circumstances.

    PKWA Family Law Team Wins Maintenance Appeal for Husband

     

     

    Our family lawyers were today successful in persuading the High Court to significantly lower the maintenance payable by our client to his wife and child.

     

    The husband had engaged us after he had been ordered to pay maintenance amounting to about 70% of his salary.

     

    In a decision announced today, the High Court agreed with us that the maintenance order was too high and that it should not be on a reimbursement basis. Our client’s payment of maintenance was reduced to a significantly lower fixed amount.

    Our Family Law Team successfully obtained a Personal Protection Order against a father for alleged sexual violence against his child.

    Family Law Head Lim Chong Boon and Deputy Head Dorothy Tan were successful in helping a mother obtain care and control of her two children in a bitterly contested legal battle spanning 3 years.

    The father had argued that the mother should not have custody because she was having an affair and was not a good parent whereas he was the more loving and caring parent.

    In a Judgment announced today, the High Court agreed and accepted our arguments that the mother is a good and nurturing mother, despite the husband’s efforts to paint her as being unfit to be a mother. The Learned Judge awarded custody of the two children to the mother and ordered the father to hand over the children to the mother within 7 days or face contempt proceedings.

    The case was bitterly fought with over 2,000 pages of documents and had lasted 3 years.

    LIM CHONG BOON and DOROTHY TAN successfully varies court order for maintenance

    (TKQ V TKR [2016] SGFC 19)

     

    Family Law Head Lim Chong Boon and Deputy Head Dorothy Tan were successful in persuading the Family Court to lower the maintenance to be paid by our client to his former wife and child.

    This was another hotly contested matter with the matter taking one year to conclude.

     

    Our client had engaged us to vary downwards a previous maintenance order. In response, the ex wife filed a counter application to vary upwards her maintenance.

     

    We argued that there have been material changes in the circumstances of the case, namely that our client had since remarried and has children from his new marriage.

     

    In a decision announced today, the Family Court District Judge agreed with our arguments and varied downwards our client’s obligation to pay maintenance. The ex wife’s application for an upwards variation was dismissed.

     

    This was another hotly contested matter with the matter taking one year to conclude.

    PKWA Law wins custody of child for husband and gets greater indirect contributions for husband

     

    In a divorce case, it is more common for the wife to get custodial rights (care and control) of the child.

     

    In this case however, Family Law Deputy Head Dorothy Tan and Tan Chao Yuan succeeded in in getting for our client (the husband) care and control of the child.

     

    This was a case where the parties were already divorced and were fighting over the custody of the child and the division of the matrimonial assets.

     

    In a decision announced today, the Singapore Family Court accepted our arguments that it is in the best interests of the child that care and control should go to our client (the father), and not the mother.

     

    The Family Court further accepted our arguments that our client had played a greater role in looking after the family and awarded him a greater indirect contribution towards the assets. The end result is that our client was awarded a greater proportion of the matrimonial assets and has care and control of the child.

     

    Mr Lim Chong Boon, Head of Family Law said, “ Our client is extremely happy with the outcome. It is not so common for a husband to win care and control of a child. Therefore, it is to our lawyers’ credit that they were able to put together a case that persuaded the judge to award our client (the husband) the care and control of the child.”

    Our lawyer wins trial against divorce filed by husband

     

    Our team of lawyers led by Mr Tan Chao Yuan today successfully defended our client (the wife) against a divorce filed by her husband.

     

    The husband filed for divorce on the ground that parties have been separated for 4 years. However, during the trial, we produced evidence that there had not been separation for 4 years.

     

    Our client did not want a divorce and had wanted the marriage to work.

     

    The Family Court accepted our arguments that our client (the wife) has successfully proven her case and dismissed the husband’s application for divorce.

    Below you will find useful information on probate matters.

     

    1. What happens when a person dies and leaves behind a property that belongs to him/her?

     

    A person, known either as an 'executor' or an 'administrator', has to be appointed by the Court to take charge of the deceased person's property (collectively known as his 'estate').

     

    If there is a will that has been made by the deceased person, it will contain details of the appointment of an 'executor' to take charge of the estate as appointed by the deceased person.

     

    If there is no will made by the deceased person, an appointment of a person known as an 'administrator' will be appointed to take charge of the estate. This administrator is usually one of the next-of-kin of the deceased.

     

    In order for such persons to be recognised legally as the executor or administrator of the deceased person's estate, applications have to be made for 'Probate' or 'Letters of Administration' respectively.

     

    2. What does a 'Grant of Probate' mean?

     

    It is a court order authorising an executor, appointed by the deceased person under his Will, to administer his estate according to the directions contained in his Will.

     

    3. What are Letters of Administration?

     

    It is a court order authorising a person(s) to administer the estate of the deceased person in accordance with the law.

     

    4. Who can apply for the Grant of Probate or Letters of Administration?

     

    Grant of Probate

    Only the executor(s) named in the Will of the deceased may apply for the Grant of Probate.

     

    Letters of Administration

    In the case of Letters of Administration, any of the deceased person's family members is entitled to apply to be appointed as an administrator. However, the law gives priority to certain members of the family over others, depending on the marital status of the deceased person and his/her family's composition.

     

    For example, if the deceased person was single, his surviving parents will have the priority over his brothers and sisters to be the administrators; or if the deceased person was married with children, his spouse will have priority over the children to be the administrator.

     

    The law also requires that at least 2 administrators be appointed where there are one or more minor beneficiaries. A 'minor beneficiary' refers to any person below 21 years of age who has a share in the estate. This is to protect the minor beneficiary's interest in the estate.
