3. Dorothy successfully represented the mother in a bitter custody battle over her 2 children. The High Court awarded our client care and control and ordered the father to hand over the children within 7 days or face contempt action. The case took 3 years and involved over 2,000 pages of court documents.
4. Dorothy successfully represented the father and won for him care and control of the children. She also got for him a greater share of the matrimonial assets.
5. Dorothy recently won a maintenance variation on behalf of the husband after she discovered that the former wife had a bank account which was not disclosed to the court.

PKWA Family Lawyers won a case for the former wife for a lump sum maintenance payment. The ex-husband had repeatedly defaulted in maintenance payments. The former wife engaged us to vary the monthly maintenance payments to a lump sum maintenance, so that she does not have to keep chasing for payments. The court agreed with us and ordered that the ex-husband pays our client a lump sum maintenance.

Family Law Department Deputy Head Dorothy Tan successfully argued and won a significant and landmark case at Singapore’s highest court, the Court of Appeal today. This is an extremely important decision because in this case, the Court of Appeal affirmed and explained its earlier revolutionary decision in ANJ v ANK on the approach the Singapore courts must take in deciding the division of matrimonial assets. All divorce cases in Singapore involving division of assets must now follow this case and ANJ vs ANK.
This is a case in which our client (the husband) had instructed us to act for him after he had lost at the lower court.
After hearing arguments, the Court of Appeal allowed our client’s appeal and agreed with Dorothy that the High Court decision was wrong and awarded our client a sum of $800,000 for division of assets. Our client’s share was increased from 0% to 25%.
The Court of Appeal said: “ In advancing her arguments, Miss (Dorothy) Tan highlighted the fact that the Judge had erred in law by applying what was generally known as the “uplift” methodology. This error consisted of taking the view that the wife’s indirect contributions should be reflected by applying an “uplift” to the share she would have been entitled to on the basis of her indirect financial contributions only. We accepted Miss Tan’s contentions on this score and we considered that the Judge had erred in that regard.”
This case is extremely important and significant because the Court of Appeal reaffirmed and clarified its recent decision in ANJ vs ANK that in determining what is a fair and equitable division of matrimonial assets, the court will follow a structured approach consisting of 3 broad steps. These 3 broad steps are:
(a) Express as a ratio the parties’ direct contributions relative to each other, having regard to the amount of financial contribution each party made towards the acquisition or improvement of the matrimonial assets;
(b) Express as a second ratio the parties’ indirect contributions relative to each other, having regard to both financial and non-financial contributions; and
(c) Derive the parties’ overall contributions relative to each other by taking an average of the two ratios above, keeping in mind that, depending on the circumstances of each case, the direct and indirect contributions may not be accorded equal weight and one of the two ratios may be accorded more significance than the other.
Family Law Head Mr Lim Chong Boon said, “ This case together with ANJ is now taken as the new law in Singapore on division of assets. After the decision in ANJ, family law practioners were trying to understand the change in law. The Court of Appeal took the opportunity in this case to explain the new law and to reaffirm it. At a recent family law seminar, this case and ANJ were cited as the new law governing the division of assets in Singapore. Deputy Head Dorothy Tan has done us all proud. Our client is also extremely happy with the outcome.”

It is axiomatic that when a former wife remarries, she is no longer entitled to maintenance payments from her former husband.
Our team of lawyers, led by Low Jin Liang, represented the former husband. Our client had engaged us to stop the maintenance payments due to a change in circumstances.
We successfully sued the former wife to stop all future maintenance payments and to claw back past maintenance.

PKWA Family Law Team Wins Maintenance Appeal for Husband
Our family lawyers were today successful in persuading the High Court to significantly lower the maintenance payable by our client to his wife and child.
The husband had engaged us after he had been ordered to pay maintenance amounting to about 70% of his salary.
In a decision announced today, the High Court agreed with us that the maintenance order was too high and that it should not be on a reimbursement basis. Our client’s payment of maintenance was reduced to a significantly lower fixed amount.
Our Family Law Team successfully obtained a Personal Protection Order against a father for alleged sexual violence against his child.
Family Law Head Lim Chong Boon and Deputy Head Dorothy Tan were successful in helping a mother obtain care and control of her two children in a bitterly contested legal battle spanning 3 years.
The father had argued that the mother should not have custody because she was having an affair and was not a good parent whereas he was the more loving and caring parent.
In a Judgment announced today, the High Court agreed and accepted our arguments that the mother is a good and nurturing mother, despite the husband’s efforts to paint her as being unfit to be a mother. The Learned Judge awarded custody of the two children to the mother and ordered the father to hand over the children to the mother within 7 days or face contempt proceedings.
The case was bitterly fought with over 2,000 pages of documents and had lasted 3 years.

Family Law Head Lim Chong Boon and Deputy Head Dorothy Tan were successful in persuading the Family Court to lower the maintenance to be paid by our client to his former wife and child.
This was another hotly contested matter with the matter taking one year to conclude.
Our client had engaged us to vary downwards a previous maintenance order. In response, the ex wife filed a counter application to vary upwards her maintenance.
We argued that there have been material changes in the circumstances of the case, namely that our client had since remarried and has children from his new marriage.
In a decision announced today, the Family Court District Judge agreed with our arguments and varied downwards our client’s obligation to pay maintenance. The ex wife’s application for an upwards variation was dismissed.
This was another hotly contested matter with the matter taking one year to conclude.
PKWA Law wins custody of child for husband and gets greater indirect contributions for husband
In a divorce case, it is more common for the wife to get custodial rights (care and control) of the child.
In this case however, Family Law Deputy Head Dorothy Tan and Tan Chao Yuan succeeded in in getting for our client (the husband) care and control of the child.
This was a case where the parties were already divorced and were fighting over the custody of the child and the division of the matrimonial assets.
In a decision announced today, the Singapore Family Court accepted our arguments that it is in the best interests of the child that care and control should go to our client (the father), and not the mother.
The Family Court further accepted our arguments that our client had played a greater role in looking after the family and awarded him a greater indirect contribution towards the assets. The end result is that our client was awarded a greater proportion of the matrimonial assets and has care and control of the child.
Mr Lim Chong Boon, Head of Family Law said, “ Our client is extremely happy with the outcome. It is not so common for a husband to win care and control of a child. Therefore, it is to our lawyers’ credit that they were able to put together a case that persuaded the judge to award our client (the husband) the care and control of the child.”
Our lawyer wins trial against divorce filed by husband
Our team of lawyers led by Mr Tan Chao Yuan today successfully defended our client (the wife) against a divorce filed by her husband.
The husband filed for divorce on the ground that parties have been separated for 4 years. However, during the trial, we produced evidence that there had not been separation for 4 years.
Our client did not want a divorce and had wanted the marriage to work.
The Family Court accepted our arguments that our client (the wife) has successfully proven her case and dismissed the husband’s application for divorce.

PROBATE & LETTERS OF ADMINISTRATION
Our team of experienced and dedicated probate lawyers, supported by a team of professional legal executives, have an extensive and varied experience in advising and obtaining Grants of Probate (where there is a will) and Letters of Administration (where there is no will).
What does a probate lawyer in Singapore do? How does a probate lawyer deal with the probate process?
When a person dies, someone needs to collect all his assets and distribute them to the beneficiaries. The probate lawyer will apply to court to get you a Grant of Probate (where the person dies with a will) or Letters of Administration (where the person dies without a will) to enable the rightful person to collect the deceased’s assets and to distribute them in accordance with the will or in accordance with the Intestate Succession Act.
To put it simply, the probate lawyer’s main job is to help family members to obtain a Grant of Probate (where there is a will) or Letters of Administration (where there is no will). These are simply court orders that identifies the rightful person to collect the deceased’s assets and to distribute them. As an example, if the deceased has a bank account, the bank will need to see this court order to satisfy themselves that they are dealing with the rightful party.
Because of our vast experience, we normally are able to complete obtaining the grant of probate or letters of administration in 1 to 2 months for most cases.

Below you will find useful information on probate matters.
1. What happens when a person dies and leaves behind a property that belongs to him/her?
A person, known either as an 'executor' or an 'administrator', has to be appointed by the Court to take charge of the deceased person's property (collectively known as his 'estate').
If there is a will that has been made by the deceased person, it will contain details of the appointment of an 'executor' to take charge of the estate as appointed by the deceased person.
If there is no will made by the deceased person, an appointment of a person known as an 'administrator' will be appointed to take charge of the estate. This administrator is usually one of the next-of-kin of the deceased.
In order for such persons to be recognised legally as the executor or administrator of the deceased person's estate, applications have to be made for 'Probate' or 'Letters of Administration' respectively.
2. What does a 'Grant of Probate' mean?
It is a court order authorising an executor, appointed by the deceased person under his Will, to administer his estate according to the directions contained in his Will.
3. What are Letters of Administration?
It is a court order authorising a person(s) to administer the estate of the deceased person in accordance with the law.
4. Who can apply for the Grant of Probate or Letters of Administration?
Grant of Probate
Only the executor(s) named in the Will of the deceased may apply for the Grant of Probate.
Letters of Administration
In the case of Letters of Administration, any of the deceased person's family members is entitled to apply to be appointed as an administrator. However, the law gives priority to certain members of the family over others, depending on the marital status of the deceased person and his/her family's composition.
For example, if the deceased person was single, his surviving parents will have the priority over his brothers and sisters to be the administrators; or if the deceased person was married with children, his spouse will have priority over the children to be the administrator.
The law also requires that at least 2 administrators be appointed where there are one or more minor beneficiaries. A 'minor beneficiary' refers to any person below 21 years of age who has a share in the estate. This is to protect the minor beneficiary's interest in the estate.
